If you are considering contacting legal malpractice attorneys over a botched medical procedure, here are a few details you want to keep in mind. Better to educate yourself first than go in to the situation blindly.
In 2004 a study of medical malpractice claims using legal malpractice attorneys in the United States found that although the incidence of negligence in hospitals produced a greater proportion of severe outcomes, the total number of errors and deaths were greater for patients treated outside of hospital settings. No single medical condition was associated with more than five percent of all negligence claims, and one-third of all claims were the result of misdiagnosis.
A couple of years later a 2006 follow-up to a 1999 Institute of Medicine study found that prescribed medication errors are among the most common medical mistakes. These harm at least 1.5 million people every single year. The study found over 400,000 preventable drug-related injuries occur each year in hospitals, over 800,000 happened in long-term care settings, and roughly 530,000 among Medicare recipients in outpatient clinics.
Another study in 2006 that was published in the New England Journal of Medicine stated that claims lacking evidence of error are not uncommon, but the majority of these are denied compensation. Fifty four percent of expenditures go toward the litigation process. The overhead costs of malpractice litigation is exorbitant when employing legal malpractice attorneys.
Now to make it even more complicated:
1,452 closed malpractice claims were studied and of the ninety-seven percent that were associated with injury, 73% got compensation. Three percent of the claims were not associated with injuries and of them, 16% got compensation. 63% were associated with errors and of them, 73% got compensation (average $521,560). Thirty-seven percent were not associated with errors and of them, 28% got compensation (average $313,205). Claims not associated with errors accounted for 13 to 16% percent of the total costs. For every dollar spent on compensation, 54 cents went to administrative expenses (including lawyers, experts, and courts). Claims involving errors accounted for 78 percent of administrative costs.
Because the system of gaining compensation from medical malpractice is so complicated, even though I do not agree with using them, enlisting the aid of legal malpractice attorneys is a good move to make. If you have suffered harm from the mistakes of the medical system, you deserve compensation.
